27 October 2006 - Indefinite Leave to Remain
There is currently guidance explaining access to LCHO products for those without Indefinite Leave to remain in the UK in the EOMHB chapter, section 2 paragraph 1.1. The guidance will also be incorporated into the Sale and KWL chapters.
At the moment the guidance in the EOMHB chapter states that applicants must be able to demonstrate that they can sustain home ownership and that applicants without indefinite leave to remain are less likely to be able to satisfy this requirement than those who do have indefinite leave to remain.
This CFG guidance (Sale and KWL chapters) will be expanded upon as soon as possible to outline that it may be discriminatory to deny applicants access to the scheme based on immigration reasons if they can demonstrate their ability to sustain LCHO. In the meantime RSLs may wish to take the view that if a mortgage company is willing to provide finance for the purchase then the individual is considered good security and therefore should be allowed access to the LCHO scheme. RSLs should adopt a case by case approach and be responsible for the decision as to whether the individual in question qualifies for LCHO.
