Model leases for housing association use from October 2008

The Microsoft Word files on this page are model leases to be used for New Build Homebuy, Social Homebuy and Shared Ownership. In providing model leases the Corporation is unable to provide any legal guidance or legal interpretation regarding their use, other than the general guidance given at CFG - Housing for Sale - NBHB- Leases. Also available is additional joint guidance on shared ownership. Should any further guidance or clarification be required, you may wish to consider seeking your own legal advice.

  • From 01 October 2008, the requirement for a restriction to be registered on the titles of shared ownership leases has been removed. This means that all of the shared ownership leases for the above schemes have been amended. You can view the new leases by opening the word files below.
  • A new Key Worker Living lease 'proforma variation' has been created for use when assigning KWL leases.  This is also available to view below. Further guidance is available in the Capital Funding Guide, New Build HomeBuy section 7.8.
  • Historic copies of our sample leases for elderly and rural shared ownership schemes are available for reference purposes from the Operational Policy Team at Maple House. Please contact the switchboard on 0300 1234 500
  • Owing to the creation of the Homes and Communities Agency (HCA) and Tenant Services Authority (TSA) the model leases have been amended to remove references to the Housing Corporation. As this is the only change, copies of the leases as they were prior to this amendment will not be made available for reference.
  • NB: The standard form of restriction contained in the following documents has not been updated following the Land Registration (Amendment) Rules 2008.  The restriction in any new leases issued should be amended in accordance with Form M and Land Registry’s Practice Guide 19. A variation to the Land Registry Restriction as above will not constitute a variation to a fundamental clause, but RSLs should familiarise themselves with any other requirements of Circular 03/08. The model leases will be revised in due course.
